Terms of Service

Truco Patrão is an online platform offered by Arya Networks B.V. (hereinafter referred to as “Truco Patrão”, “Arya” or “We”) that enables users (“You” or “User”) to play Truco online with other users. These terms of service for Truco Patrão (“Terms”) along with Truco Patrão’s Privacy Policy (“Privacy Policy”), Responsible Gaming Policy, AML Policy, and the cumulative set of Game Rules (defined below) (together “Platform Policies”) govern the relationship between You and Arya. The Platform Policies form a binding legal agreement between You and Arya, especially when You visit, access, or use the Truco Patrão product, website, mobile applications, and related services (“Services”).

Please read these Terms carefully before using Our Services. By using the Services, You agree and accept to be bound by and abide these Terms. If You do not agree with any part of the Platform Policies or any subsequent modification therein, You must stop accessing or using Our Services and You may request a refund of the amounts deposited into your account, in accordance with the rules defined in this Term. This Term constitutes a valid and enforceable contract executed between Arya and You, subject to the terms foreseen herein and any applicable legislation. not subject to any type of prior authorization simply because it is provided electronically.

We reserve the right to periodically review, update, or otherwise modify any part of the Platform Policies at Our sole and absolute discretion. You will be notified of any material changes to these Terms through in-app notifications, emails or text messages or such other mode communication as may be available. If You do not agree with the new conditions or any adjustments made in the updated version of these Terms, please do not use our Services. The changes will be in effective on the date that is included in these new Terms.

In the event that one or more of the terms hereunder are determined to be invalid or unlawful for any reason, by a competent judicial or quasi-judicial authority, the validity or enforceability of the remaining terms will not be affected and the same will be valid, and binding on You and all other users.

1. Definitions:

1.1. “Account” means the User account maintained with Truco Patrão, which enables Users to play Games.

1.2. “AML” means the User account maintained with Truco Patrão, which enables Users to play Games.

1.3. “Bonus Segment” means the segment of the Account to which bonus and any amount under any other promotional offer on the Platform are credited to a User.

1.4. “Game Fee” mean the value required to be deployed by a User to play a Cash Game on the Platform.

1.5. “Cash Games” means Games involving a financial stake, as determined by the participants of that Game, in accordance with the Game Rules.

1.6. “Communication Feature” means the in-game feature that enables users to interact with each other during a Game.

1.7. “Deposit Balance Segment” means the segment of the Wallet wherein any money deposited by a User with Truco Patrão to play a Cash Game is credited. Amounts lying in the Deposit Balance Segment cannot be withdrawn directly by the user.

1.8. “Discounts” include any Instant Cash, Bonus, discounts, prizes or any other incentives that may be provided by Arya, at its discretion, as a part of promotional measure.

1.9. “Game(s)” means the game of Truco offered on Truco Patrão and shall include the various formats and variations of Truco available on Our Platform as defined in the Game Rules.

1.10. “Game Rules”, means the rules and regulations applicable to a Game which are accessible on the Platform

1.11. “Instant Cash” means a non-monetary incentive provided by Arya at its discretion, as a part of the promotional measure that can be utilized by a User as Game Fee for a Cash Game. Instant Cash cannot be withdrawn by a User and is subject to expiry as notified during the time of its grant.

1.12. “KYC Verification” means the process by which We collect certain information from You to establish your identity and conduct customer due diligence. This information includes your first name, last name, date of birth, CPF (Cadastro de Pessoas Física, the Brazilian Individual Taxpayer Registry identification number), email address, phone number, IP address, location data, and payment details such as Pix ID (Brazil’s instant payment system), or debit/credit card information.

1.13. “Platform” means the Truco Patrão website and related mobile/desktop applications on which Games are made available to users in different formats and variations

1.14. “Platform Charge”/ “Service Fee” means the amount charged by Arya from the Users for hosting Cash Games and other content on its Platform and for providing access to the Users to participate in the Cash Games.

1.15. “Platform Policies” mean the Terms, Privacy Policy, and Fair Play, Responsible Gaming Policy, and the cumulative set of Game Rules for each Game.

1.16. “Refund” means the refund of the amounts paid by a User to play a Cash Game to such User’s Account.

1.17. “Username” means the default name created for You once You create an Account on Truco Patrão.

1.18. “User Information Submission” means the process by which You provide certain required information throughout various stages of gameplay to facilitate identity verification and compliance with KYC Verification.

1.19. “Wallet” mean the section of the Account that enables Users to deposit and utilise funds on the Platform.

1.20. “Withdrawable Balance” means the amount in the Withdrawable Balance Segment.

1.21. “Withdrawal/Withdraw” means the transfer of all or part of the Withdrawable Balance to a designated bank account of a user, upon specific instructions by that User to Truco Patrão to initiate such transfer.

1.22. “Withdrawal Request” means a request by the User on the Platform to initiate Withdrawal.

1.23. “Withdrawable Balance Segment” means the segment of the Wallet to which the winnings (either in full or in part) of the Users from the Cash Games are credited.

2. Who may use Our Services:

2.1. OUR SERVICES ARE INTENDED FOR PERSONS WHO ARE RESIDENTS OF BRAZIL AND ARE ABOVE THE AGE OF 18 (EIGHTEEN) YEARS. Our Services are not designed for or should be offered to any person below the age of 18 (eighteen) years, or persons who are not residents of Brazil or access the Platform from a country outside of Brazil. Therefore, You declare that you are legally above 18 (eighteen) years old and that you are a resident of Brazil. We have the right to control the access to Our Services at all times in any location in Brazil.

2.2. If You are under 18 (eighteen) years old or not a resident of Brazil or located outside of Brazil, You may not access and use Our Services. In order to comply with our legal and regulatory obligations, especially for KYC process, we may ask you to provide request some documents and personal details and/or documentation (, such as such as a copy of your ID or other government-issued photographic proof of identity, proof of address, payment method details, bank statements and/or other evidence), which will also be necessary to confirm your identity and registration. We reserve the right to place restrictions on your account (including, for example, the ability to withdraw, deposit, or access Truco Patrão ) until you provide the requested information and/or we have completed such verifications to our reasonable satisfaction. Please see our Privacy Policy for more information on how we use this personal data.

2.3. We may terminate your access and use of the Services if We become aware of or believe that your use and access of Our Services violates the Platform Policies.. It is noteworthy that any violations to the Platform Policies will be duly investigated internally by us, in accordance with our internal policies and procedures and We will give You the opportunity to contest any of our decisions.

3. User Account Creation and Usage of Our Services:

3.1. Arya allows You to play Truco Patrão on an online mobile application, which can be downloaded and installed from Our website www.trucopatrao.com, Google Play Store, the Apple App Store and/or other app stores as may be available.

3.2. To access the Platform and the Services, You must create an Account on the Platform. To register, You must provide a valid phone number or your Google ID, Facebook ID, Apple ID or any other required information. A one-time password (OTP) will be created to confirm your phone number. You agree to provide true, accurate, current and complete information at the time of registration or when required by Us during your access to the Platform. Each user can only create one single Account on Truco Patrão, so You cannot have more than one Account on Truco Patrão and the Services, even if you use different e-mails, IDs or information to create an Account. YOU ARE ALSO PROHIBITED FROM IN ANY WAY USING MULTIPLE ACCOUNTS ON THE PLATFORM. IF WE DETECT MULTIPLE ACCOUNTS FOR A SINGLE USER, WE MAY TAKE THE NECESSARY MEASURES, INCLUDING CANCELLATION OF ALL AMOUNTS RELATED TO DISCOUNTS ON LINKED ACCOUNTS, AND SUSPENSION OF THE LINKED ACCOUNTS.

3.3. You may amend or change the Username, provided that it complies with these Terms. The Username must not be indecent, objectionable, offensive, or unlawful. Usernames that violate the intellectual property of any entity, reveal personal information, or be suggestive of an advertising or promotional activity, may be rejected. Your Username will remain active unless We terminate or suspend your access to the Platform due to any violation of the Platform Policies, or your Account becomes inactive as provided by Clause 10.

3.4. Your Account is personal and may not be transferred to any third party for any purposes, including if you do not wish to access the Platform anymore.

3.5. When You access Our Services and/or create an Account, We may collect, use, share with third parties, store, or otherwise process your information, which may include your personal information, to ensure that the Services may be accessed and used by You efficiently. The collection, use, sharing of such information is governed by the Privacy Policy which forms an integral part of the Platform Policies. You may access the Privacy Policy here.

3.6. When You register with Us, You agree to receive promotional and service messages from Us, and our affiliates, through SMS, email, call, WhatsApp, and push notifications, in relation to tournaments, offers, and discounts (of various types and nomenclature). You may withdraw your consent to receive such communications by sending an email to support@TrucoPatrao.com.

3.7. Internet connectivity issues at your end, disruptions due to your local internet environment, errors in the setup of software or hardware of your device, or other factors not directly attributable to Us, are beyond Our control. Therefore, You agree that We will not incur any liability for any halts, breaks, or interruptions in your usage of Our Services on account of such issues.

3.8. Winnings (whether monetary or non-monetary) and Discount (which are strictly non-monetary) are unique to each player and are non-transferable. In the event You attempt to transfer any winnings or Discount, such activity it shall be considered a violation of these Terms and any winnings or Discounts will be forfeited at based on Our sole discretion.

4. Game Formats and Rules:

4.1. Truco Patrão provides the game of Truco in various formats and variations on the Platform, including Cash Games and non-cash Games. We may increase or reduce the number of Game formats and variations offered on the Platform, at Our sole discretion. You shall have the option to choose the Game of any Game Fee depending on your skill level and knowledge.

4.2. You agree to abide by the applicable Game Rules when playing Games on the Platform. You are required to ensure that You have read and understood the applicable Game Rules before playing any Game. The Game Rules form part of the Platform Policies and can be found by clicking “Rules” below the heading of the type of game selected by You on the Platform.

4.3. We may, from time to time, make additional Games available on the Platform. All such Games must adhere to the Platform Policies, and the relevant Game Rules for each new Game will be made available to You. If any new Game introduces specific workflows, requirements, or compliance standards beyond the existing Platform Policies, these additional requirements will also be disclosed and clearly outlined alongside the Game Rules.

4.4. The results and winners of each of the Games are determined following the applicable Game Rules and solely based on the skill of players. By registering and/or participating in any Game You agree to these provisions, which may not be challenged. We will post lists of winners on Our Platform following each Game.

4.5. If any Game Rules provided in the specific Game is contrary to these Terms, these Terms shall prevail.

5. User’s Code of Conduct

5.1. You fully understand and agree that you shall be responsible for all actions related to your Account, including any content you post and the consequences arising therefrom.

5.2. Aside from using the Platform pursuant to this Terms, You shall not engage in any activity that infringes the intellectual property of Truco Patrão or any other third party or in any activity that is harmful to the legitimate interests of Truco Patrão or other third parties.

5.3. You shall comply with the applicable laws and regulations during the use of the Game, the Platform and/or the Service. You shall not use the Platform to engage in any illegal or unlawful conduct including not uploading, distributing, transmitting, publishing, sharing, displaying, or posting any content through Our Services or any service or facility, including any Communication Feature, provided by Us which:

  1. belongs to another person and to which You do not have any right;
  2. is defamatory, slander, obscene, pornographic, paedophilic, invasive of another’s privacy, including bodily privacy, insulting or harassing on the basis of gender, race or political or religious beliefs, libellous, racially or ethnically objectionable, relating or encouraging money laundering or gambling, or otherwise inconsistent with the well-being of our players or contrary to the laws in force;
  3. is harmful to a child;
  4. constitutes offensive language, such as the use of any kind of profanity or hatred language;
  5. infringes any intellectual property rights, such as patent, trademark, copyright or other proprietary rights;
  6. deceives or misleads the addressee about the origin of the message or knowingly and intentionally communicates any information which is patently false or misleading but may reasonably be perceived as a fact;
  7. impersonates another person or entity;
  8. threatens the unity, integrity, defence, security or sovereignty of Brazil, friendly relations with foreign states, or public order, or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting other nation;
  9. contains a software virus or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource;
  10. is patently false and untrue, and is written or published in any form, with the intent to mislead or harass a person, entity or agency for financial gain or to cause any injury to any person or entity;
  11. is otherwise objectionable or undesirable (whether or not unlawful);
  12. is aimed at soliciting donations, chips or other forms of help or attempt to in any way violate or circumvent the Platform Policies;
  13. disparages Arya or any of its subsidiaries, affiliates, licensors, associates, partners, sponsors, products, services, or websites, in any manner;
  14. promotes a competing service or product;
  15. violates any applicable laws or regulations.

5.4. The Communication Feature may be immediately suspended without any warning when We believe that the user is indulging in any activity prohibited under Clause 5.3. above, or elsewhere in the Platform Policies. This may also lead to suspension of the Account. You may report any abusive or malicious behaviour by any other user to us by following the complaints procedure provided in Clause 16 below.

5.5. You shall not host, intercept, emulate, or redirect proprietary communication protocols, used by Us, if any, regardless of the method used, including protocol emulation, reverse engineering, or modification of Our Services or any files that are part of it.

5.6. You shall not use the Game or Our Services through third-party software, plug-in, cheating tool or system that is not developed nor authorized by Truco Patrão, or creating, publishing and propagating third-party software, plug-in, cheating tool and system that is not developed nor authorized by Truco Patrão.

5.7. You shall not frame Our Services, impose editorial comments, commercial material or any information on Our Services, alter or modify any content, or remove, obliterate or obstruct any proprietary notices or labels.

5.8. You shall not use Our Services for commercial purposes, including but not limited to use in public spaces as a computer gaming centre, network play over the Internet, or through gaming networks, or connection to an unauthorized server that copies the gaming experience offered by Us. Additionally, you may not, in any way, provide any services or products which will require you or a third party to access an Account that is not validly owned by its owner (meaning you or them, respectively).

5.9. You shall not purchase, sell, trade, rent, lease, license, grant a security interest in, or transfer your Account, content, money, points, standings, rankings, ratings, or any other attributes appearing in, originating from, or associated with Our Services.

5.10. You shall not engage in any illegal activity or infringe legitimate rights of Truco Patrão and other third parties, including without limitation: (a) illegal and/or malicious registration and login of the Game, including malicious batch registration of Game accounts, as well as login of the Game by destroying server authentication and malicious crowding service; (b) malicious implementation that may lead to Game server downtime, stuck, or other Game players offline, delay and other abnormal Game behaviours, such as using DDoS to attack Game server or other players’ network traffic, etc, (c) taking advantage of Game loopholes (including but not limited to swiping virtual currency, points or virtual props), destroying the game environment or causing adverse effects to other players; (d) behaviour of installing and using the third-party software that affects the balance of the Game; (e) your Game data performance is abnormal, affecting other behaviours of the Game fairness; (f) the same player (or the same IP, or the same physical address) registers or logs in multiple Game accounts; (g) cheating behaviours in the Game, intentionally escaping after betting or in the Game, resulting in losing Bonus, Instant Cash, Deposit balance, or other virtual props to other players, unreasonably delaying the Game or Game time and affecting the fairness of the Game, etc.(h) the behaviour of insinuating or pretending to be Truco Patrão internal staff or a special identity in some way in an attempt to obtain illegitimate interests or influence the rights and interests of other users; (i) conduct Game account trading, account sharing and other behaviours that affect account security; or (j) other behaviours that violate laws and regulations, infringe the legitimate rights and interests of other users, interfere with the normal operation of the Game or Truco Patrão does not explicitly authorize.

5.11. Any form of fraudulent activity, including but not limited to attempts to access or use another individual’s credit card(s), debit card(s), net-banking credentials, authorization codes, prepaid cash cards, or mobile devices to add funds to the Deposit Segment, as well as accessing or attempting to access the Services through a third party’s Account, is strictly prohibited. Additionally, behaviours associated with money laundering—including, but not limited to, concealing the origin of transactions or circumventing transaction limits—are expressly prohibited. The Platform shall actively monitor transactions for indicators of suspicious activity in alignment with AML best practices and reserves the right to report such activities to relevant authorities where appropriate. Furthermore, if suspicious activity is detected or if any violation of the Terms is identified, the Platform may terminate the relevant Account. Users flagged for suspicious activity will be notified and given an opportunity to verify account use, ensuring transparency and fairness in the process.

5.12. If You are an officer, director, employee, consultant, or agent of Arya, or a relative of such persons, You are not permitted to play either directly or indirectly, any Cash Games which entitle You to any prize in the game in the course of your engagement with Arya.

5.13. You undertake that You will not permit any other person to access or use your Account and You will not use any form of external assistance to play the Games or indulge in any activity that violates the Platform Policies. This means you may not use any cheats, hacks or any other unauthorized software to assist you in playing the Games and may not authorize any third party to access your Account to play the Games.

5.14. You are prohibited from utilising Our Services for any restricted or unlawful purpose including, attempting to launder funds available in your Wallet or deliberately losing money to a certain player(s).

5.15. You shall not send to the users of the Platform any form of unsolicited communication for any other purpose.

6. Deposit, Payment, Withdrawal, Refund, and Cancellation:

6.1 As provided above, only Users that are above 18 (eighteen) years old are allowed to use the Platform and, therefore, carrying out financial transaction within the Platform or the Services.

6.2 Deposit

6.2.1. All payments on the Platform will have to be made through your Wallet, by following the process indicated therein. Any money deposited by You with Truco Patrão is credited to the Deposit Balance Segment, and your winnings are credited to the Withdrawable Balance Segment automatically. your Wallet also provides a record of all transactions made by You on the Platform.

6.2.2. All funds collected from You are held in trust by Arya and kept unencumbered in a designated account.

6.2.3. All transactions You make with Us must be in Brazilian Real (BRL) and We do not accept any deposits in any other currency or in the form of virtual digital assets. You are free to deposit funds in the Deposit Balance Segment for the purpose of participating in Cash Games, subject to the following conditions:

  • a. You can only deposit up to 50000 BRL (only) to the Deposit Balance Segment in a single transaction;
  • b. the daily deposit limit set by Us with undertakings, indemnity, waiver, and verification conditions as We deem appropriate in Our sole discretion. We may set up daily limits on the amount of deposit, You can make on the Platform, You will be notified of such applicable discretionary deposit limits on the Platform. It should be noted that the limits for adding cash to your Account may be changed by Us, at our discretion and in accordance with our internal policies and procedures, after considering certain parameters, including without limitation, gameplay or user behaviour; and

6.2.4. The deposits made by You in the Deposit Balance Segment are to enable your participation in the Cash Games and do not carry or generate any interest or return. You shall not be allowed to transfer the balance lying in the Deposit Balance Segment to any other Segment without Cash Gameplay.

6.2.5. When you deposit money into the Deposit Balance Segment, Arya will automatically issue an invoice against the deemed supply of specified actionable claims by Arya to You. This invoice will be sent to the email address provided as part of the User Information Submission.

6.2.6. If the Platform allows any form of fund transfer between users’ Wallets, You may only transfer funds under the specific conditions and limitations set by the Platform. In any case, You are strictly prohibited from transferring any funds from Your Wallet to the Wallet of another user unless expressly authorized by the Platform in accordance with applicable guidelines.

6.2.7. You hereby represent and warrant that the payment instrument or method used to add funds to Your Wallet belongs to You and is used solely for lawful purposes. You further affirm that all funds added to Your Wallet are of lawful origin and are not derived from any illegal activities, including but not limited to fraud, corruption, or other forms of illicit conduct. Additionally, You declare that You are not using the Platform to engage in money laundering, terrorist financing, or any other unlawful financial practices. This includes any efforts to disguise, transfer, or conceal the origin of funds or to evade regulations. By making this declaration, You commit to using the Platform in full compliance with all applicable financial laws and regulations, supporting the Platform’s commitment to AML compliance and the legitimate use of its services.

6.2.8. Credit cards, debit cards, prepaid cash cards, and Internet banking payments are processed through third-party payment gateways. Similarly, other payment methods may also require authorization by the entity which processes such payments. You understand and agree that We are not responsible for any delays or denials in processing payments at their end. The payment processing will be carried out in accordance with those providers. You acknowledge that we are not responsible for any third-party action.

6.2.9. You may send a complaint to Us in the event of any issues related to the cash deposit in the Platform, as provided by Clause 16 of theses Terms.

6.2.10. You acknowledge and agree that We are not liable for any delays or declination to your credit.. Once a payment/transaction is authorized and confirmed, and the funds are received by Us, the amount is credited to the Deposit Balance Segment and is available for You to play Cash Games.

6.2.11. We have the right to cancel a transaction at any time and at Our sole discretion, and if the relevant payment is successfully done, the transaction will be reversed and the money credited back to the original source of payment. Delays in any refund may be applicable in light of policies or procedures applicable to your payment method.

6.2.12. As part of the Terms and in accordance with anti-money laundering legislation, Users should be aware that they may be required to provide personal documentation (such as government-issued identification, bank statements and bills) for their transfer to be processed. This allows us to help protect our Users and prevents our Platform from being used as a vehicle for money laundering or fraud.

6.3. Withdrawal

6.3.1. You may Withdraw all or any part of the Withdrawable Balance to your bank account, which will be processed through electronic wire transfer or any other preferred mechanism available in our Platform and in compliance with applicable laws and regulations.

6.3.2. During the Withdrawal Request, You must provide Us with the details of the bank account to which the funds are to be credited. The bank account must legally belong to You.

6.3.3. Withdrawal Request will be accepted by Us subject to further KYC Verifications, alignment with the deposit method, and/or security reviews by Our automated systems and risk management team. You agree that all Withdrawals You make are governed by the following conditions:

  • The Withdrawal Request is limited to one every 24 (twenty-four) hours unless otherwise allowed by applicable Platform Policies or ongoing promotional offerings (if any).
  • You can Withdraw all or any part of your Withdrawable Balance.
  • The minimum amount of the Withdrawal Request is BRL 1 (one real) and the maximum is 50,000 BRL (Fifty thousand, per transaction. We also reserve the right to disburse the amount to the financial instrument/mode used to add cash to your Deposit Balance Segment. The foregoing limits on withdrawal may be changed or modified by Us from time to time.

6.3.4. Bank transfers processed through PIX will be sent for processing withdrawal within 24 hours.

6.3.5. Withdrawal Requests shall, subject to Withdrawal restrictions specified in these Terms and the Platform, be processed post your KYC Verification. We may ask you to perform the User Information Submission at any stage to verify your identity/address.

6.3.6. Discounts are non-monetary and not Withdrawable and are subject to the terms and conditions applicable to their grant.

6.3.7. We will make reasonable efforts to ensure that transfers to and from your account are processed promptly. However, we do not guarantee the time it will take to complete such transactions. We are not responsible for delays caused by banking networks, processor failures, or actions taken by third parties involved in the processing of funds, which may lead to delays, reprocessing, reversals, or the seizure or freezing of funds. We will not be liable for any direct or indirect damages arising from such delays or seizures.

6.3.8. Additionally, we are not liable for any direct or indirect damages resulting from delays or losses caused by invalid, incomplete, or incorrect financial or personal information provided by the User with their transfer request.

6.4 Refund

6.4.1 You may request a Refund of any unutilized funds in your Deposit Balance Segment by contacting support@TrucoPatrao.com, completing the User Information Submission and subject to the following conditions:

  • Upon receipt of a Refund request from You, the Refund will be processed within 2 (two) weeks from the date of receipt of such Refund request and the requisite Refund amount shall be credited to the original source used to add such funds. We will attempt to refund the amount to the original source using the payment gateway and may be subject to delays, pending the refund policy of the payment method. If a Refund request fails due to any reason on the payment gateway side, which is beyond Our control, the users will be provided an alternative of moving the amount from the Deposit Balance Segment to the Withdrawal Balance Segment, which a User may then be able to withdraw after completing the User Information Submission.
  • You may raise a Refund request no later than 180 (one hundred and eighty) days of adding such funds to your Deposit Balance Segment.

6.4.2. If a Cash Games is cancelled by us due to any technical glitch or any other reason that impacts the performance of the Cash Game, you will have the right to refund any amount that You have deposited, as provided by the specific policies for the Cash Game.

6.4.3. Your winnings may be disclosed to the relevant authorities, and requisite amounts may be withheld from payouts, to ensure compliance with applicable laws and regulations and lawful requests from the government, regulatory bodies, tax authorities, or an order of any court of competent jurisdiction. It is your responsibility to ensure the due remittance of all the applicable taxes.

7. Customer Due Diligence and KYC Verification:

7.1. We require certain information from You, to establish your identity and undertake customer due diligence processes.

7.2. Further, we require User Information Submission in the following scenarios:

  1. where You place a Withdrawal Request;
  2. where We suspect or have been notified that You have violated any of the Platform Policies; where You have been identified to be in breach of the applicable add cash thresholds;
  3. where You have been provided any promotional offer from the Platform or have any winnings credited to your Wallet;
  4. when You deposit more than 10,000 BRL
  5. as may be required under applicable laws and regulations;
  6. as may be determined by Arya in its sole discretion from time to time.

7.3. As part of Our KYC Verification, Our automated system enables a mandatory process for users to upload documents/ information pertaining to their Cadastro de Pessoas Físicas (CPF) and bank account details.

7.4. The User must use a bank account with the same name and CPF (Cadastro de Pessoas Físicas, the Brazilian Individual Taxpayer Registry identification number) as provided in their registration on the Truco Patrão Platform when transferring funds to their Truco Patrão Account. If a mismatch is detected between the bank account details and the registered information, Arya reserves the right to suspend the User’s Account. In such cases, the User will be notified of the suspension and provided with instructions for contacting support to complete the necessary verification process. Withdrawals from a Truco Patrão Account by bank transfer will only be paid to a bank account matching the name and CPF used at registration. This process ensures compliance with security and AML requirements, while keeping the User informed and guiding them through the steps needed to resolve discrepancies.

7.5. The User Information Submission must be performed through our Platform, and We do not accept submissions in any other form or manner.

7.6. At the time of uploading the document/ information on Our Platform, You must ensure the following:

  • documents are valid;
  • the document is clear and legible, and shared in a jpg, jpeg, or pdf format;
  • documents are not password protected.

7.7. The validation of the User Information Submission documents may take up to 3 (three) working days from the date of submission of the documents. We reserve the right to validate and/or reject the User Information Submission at our sole discretion. You will be notified of the status of KYC Verification on your registered mobile number/email address and/or on Our Platform.

7.8. You hereby agree that We engage third party service providers to conduct KYC Verification your Withdrawal request, accordingly, the Personal information provided by You will be shared by Us with these third party service providers and You hereby consent to such sharing of information. More details relating to this can be found in our privacy notice.

7.9. If we mistakenly credit your Account with winnings that do not belong to you, whether due to a technical or human error or otherwise, the amount will remain our property and the amount will be transferred back to us from your Account. We reserve the right to void any transactions made using incorrectly/erroneously credited funds, including related winnings paid in error. In order to satisfy any liability, we further reserve the right to freeze and retain such funds and set off any subsequent winnings due to you. If, before we become aware of the error, you withdraw funds that do not belong to you, without prejudice to other remedies and actions that may be available to us at law, the amount unduly paid will constitute a debt owed by you to us. In the event of an incorrect credit, you are obliged to notify us immediately by email to support@TrucoPatrao.com.

8 Discount and Prize:

8.1. When You add cash to the Deposit Balance Segment, You may be allotted a certain bonus or other promotional currency, depending on the existence of ongoing promotional offers. The bonus allotted to you shall appear in the Bonus Segment of your Account. Such bonuses depend on some conditions, such as your continued usage of Our Services or participation in Cash Games and may be issued at Our sole discretion and cannot be claimed by You as a matter of right. Therefore, the bonus may be released in a phased manner in accordance with the fulfilment of the applicable conditions mentioned above You understand that the bonus must be earned (disbursed) within the stipulated claim period, which may differ based on the ongoing offers The release percentage/rate may vary depending on the offer, and the user. The bonus shall have such limited validity as may be communicated to You at the time of its issuance. Please review the “How does Bonus work?” section on the Platform (under the details of the Wallet) for further details on how the bonuses work on Truco Patrão.

8.2. In the event your Account is terminated by You voluntarily, or by us in accordance with these Terms, all bonus or Discounts issued to You shall be forfeited and You shall have no further right or interest in such Bonus.

8.3. Any violation of the Platform Policies at any stage may result in disqualification from receiving the Bonus or promotional winnings.

8.4. You may win prizes while playing Games on the Platform. Such prizes are subject to the specific terms and conditions communicated at the time of issuance of the prize.

8.5. The amounts in the Bonus Segment are not redeemable for any other prize, nor can they be Withdrawn directly, or transferred to another user.

9. Service Fees and Taxes:

9.1. Truco Patrão charges a Service Fee on each Cash Game played on the Platform by a User, which may vary depending on the nature of the Cash Game and is subject to change from time to time, as indicated in Clause 9.2 below. Truco Patrão reserves the right to levy different Service Fees for different Cash Games at its sole discretion.

9.2. Details pertaining to each Game transaction, including the applicable Service Fee will be accessible by You on an information panel made available to You before You initiate a Cash Game. The Service Fee charged shall be inclusive of applicable taxes at the rates mandated under applicable laws and regulations. Variations to Service Fees in the manner set out in this Clause 9, may impact the overall transaction details of a Cash Game, including the taxes applicable thereon, and hence you are advised to periodically check the information panel. If You require any further information on any aspect of the Service Fee, including the tax components thereof, You may write to us at support@TrucoPatrao.com

9.3. Users who fulfil certain specific criteria may, at the sole discretion of Arya, receive Discounts from the service fee charged for a particular Game or a set of Games in line with the market conditions, business practices and trade parlance, even after the conclusion of the Game(s). Accordingly, such post-facto Discounts by Arya will reduce and reverse a part of the Service Fee applicable to a Game, and these updates to the Service Fee will be reflected on the information panel available to each user on the Platform.

9.4. Discounts may be granted to users based on several parameters related to the usage of the Platform by the user, including the frequency of Games played, participation in tournaments or special Game types, overall winnings, conduct on the Platform, players referred to the Platform, etc.

9.5. All forms of Discounts and other bonuses, promotional winnings and rebates offered by Arya to a user shall not exceed the total Service Fee chargeable to such user, and Arya has the right to reduce and vary Discounts and promotions accordingly. Furthermore, such Discounts and promotions may be subject to specific conditions, as provided above.

10. Termination, Suspension, and Opt-out:

10.1. If You do not log in to your Account at least once in a 12 (twelve) month period or have not participated in any Games on the Platform for the same period, your Account shall be considered inactive and a maintenance fee of up to 100 BRL (hundred only) per year may be chargeable, at Our sole discretion against any funds remaining in your Wallet (“Inactive Account Fee”). This Inactive Account Fee is to cover the technical costs involved in such freezing, holding any amounts in escrow for users etc. In the event of a levy of such fee, Arya will issue an invoice to You, which shall be available for You to download on the Platform from the Wallet section.

10.2. Without prejudice to any other rights that Arya may have under applicable laws and regulations, We may take the necessary measures we deem appropriate, including immediately blocking the User’s access to the Service, terminating the User Account on the Platform, seizing or quarantining all monies held in the User’s account on the Platform and/or taking legal action against such User, if We find that the User is violating any of our Platform Policies, or breaching/attempting to breach the security of Our Services in any manner, or engaging in any of the below activities, including without limitations:

  • having more than one active account to play Cash Games or tournaments;
  • the name on the your Account does not match the name on the bank account used to make deposits into that account;
  • provide incorrect or misleading information to Us when registering for the Service;
  • you become subject to restrictions that prohibit Arya from trading with you or performing any financial services for you;
  • you are not of legal age to use the Service;
  • you reside in a jurisdiction where use of the Service is prohibited by law;
  • you have authorized or permitted (intentionally or unintentionally) another person to play using Your Account;
  • you have made chargebacks, and/or denied or reversed any payment made by You in connection with the Service;
  • you have cheated in using the Service, including by violating any provision of Clause 5;
  • you use the Platform, the Service or your Account in bad faith; or
  • you have engaged in making sexually explicit or offensive statements in the chat, including expressions of bigotry, racism, hatred or profanity.

10.3. You agree to fully indemnify, defend, and hold harmless Arya, its directors, and employees from and against all claims, demands, liabilities, damages, losses, costs, and expenses, including attorneys’ fees and any other charges whatsoever, howsoever caused, that may arise as a result of:

  • breach by you of the Platform Policies, in whole or in part;
  • violation of any law or third-party rights; and
  • the use of the Service by You or by any other person accessing the Service using your Login Details (as defined below), with or without your consent.

10.4. If your Account is terminated by Us in accordance with Clause 10.2, You will:

  • not be permitted to use Our Services;
  • be permitted to Withdraw the Withdrawable Balance, subject to applicable restrictions in the Platform Policies regarding the Withdraw requests.

10.5. Further, if We find that a user is breaching/attempting to breach Our security or privacy protocols, We may, following an internal investigation, decide to undertake a range of remedial actions, depending upon the severity of the detected breach, which may include the following:

  • stop access and usage of Our Services, indefinitely, by such user;
  • permanently terminate such User’s Account;
  • restrict Withdrawals for such user;
  • demand compensation for the loss to Our Services that occurred because of the breach and prosecute a user for any violation of the law and the Platform Policies if need be;
  • prohibit the user from registering with Us in the future.

10.6. If We believe or suspect that You have been engaged in Fair Play Violation:

  • we will notify You such breach/attempt to breach;
  • we may investigate and monitor your Account and your gameplay for such period of time to investigate the breach. The investigation may be carried out for period of 180 (one hundred eighty) days from the date of notification of such breach. The balance funds of both users guilty of Fair Play Violations will be frozen for a period of 180 (one hundred eighty) days. Such investigation will cover all the games that the concerned User has played since the time of registering on the Platform.
  • if We, upon the investigation, consider that your Account is or has been engaged in Fair Play Violations, considering the amount involved in the Fair Play Violations, We may:
    • forfeit the funds in Your Wallet;
    • repatriate the amount to the User or individuals who have been affected by the Fair Play Violation;
    • charge a Fair Play violation compensation of 500 BRL (Five Hundred) per instance of the Fair Play Violation. You acknowledge that such compensation is reasonable and justifiable damages considering the manpower and technology costs and loss of reputation that We may suffer due to your violation of the Fair Play Policy. The Fair Play violation fee may be debited from the funds in your Wallet or if the balance in your Wallet is not sufficient to cover the fee, we may raise a claim for such fee against You, in accordance with applicable laws. Also, You understand that, if You have any questions or would like to contest any violation compensation, You may contact us through support@TrucoPatrao.com.

10.7. For the purpose of these Terms, “Fair Play Violation” means any activity of a User that violates the Platform Policies, and includes, without limitation:

  • activity that uses unfair means, digital or not, to manipulate the outcome of a game on the Platform, irrespective of whether this in favour of the user adopting such means;
  • activity that is fraudulent, illegal, or unfair activity, as determined by Arya in its sole discretion or under determined by applicable law;
  • activity that is intended solely to transfer funds from one person to another person, or between distinct sources, thereby amounting to money transferring;
  • activity that involves collusion between two or more players to achieve a result during a game, thereby amounting to syndicate playing; and
  • any other activity as may be determined by Truco Patrão, from time to time.

If We are informed of a cyber fraud or any other fraudulent activity related to a User’s Account by a governmental, police or any law enforcement authority or agency, then We reserve the right to (a) suspend your Account; and (b) transfer any funds lying in your Wallet to such Bank Account as may be instructed by the governmental, police or any law enforcement authority or agency. We also reserve the right to block any and all Withdrawals from your Wallet upon instructions from the Government, police or any law enforcement authority or agency.

10.8. You are free to discontinue using Our Services/[delete Your Account] at any time by sending Us an email indicating such intention at support@TrucoPatrao.com (“Discontinuation[/Deletion] Request”). You hereby agree that once We receive a Discontinuation[/Deletion] Request from You, Your Account will be discontinued and You shall not be able to undertake any activity on the Platform, save and except as may be allowed by Arya at its sole discretion. If at such time, there is a positive balance in your Wallet , We will disburse the amount to You by electronic wire transfer, in accordance with these Terms, subject to any applicable charges, including a discretionary account closure fee of up to 10 BRL (Ten only) or ten (10) percent of the total funds to be transferred, whichever is higher. Such discretionary account closure fee may be charged for certain users at our discretion based on certain factors, including but not limited to, applicable Platform Policies, applicable costs for processing the disbursement of funds (if any) or technical capability of the relevant third-party processing such disbursement. In the event of a levy of such fee, Arya will issue an invoice to You which shall be available for You to download on the Platform from the Wallet section.

11. Your Representations and Warranties:

11.1. You here represent, declare, agree and acknowledge that:

  • Arya is not a financial institution and there will be no interest on deposits made on the Platform to play Cash Games or prizes won by You for reaching 1st place in competitions, deposited with us;
  • You are eligible and competent to enter into transactions with other users and Arya. Your use of the Service is at the User’s sole option, discretion and risk;
  • You are solely responsible for any taxes that may be levied on the cash prizes won in the Cash Games;
  • Any information You provide to Us at any time during the access and use of Our Services, whether at the stage of registration or any time thereafter is correct, complete, up-to-date, and accurate. We shall not be liable against any claim relating to the accuracy, completeness, and correctness of any information You provide Us. We may, at any time and at Our sole discretion, require You to verify the correctness, completeness, and accuracy of such information, and to that extent require You to produce additional documentary proof. Where You fail to provide Us with valid documentary proof, We reserve the right to limit your access and use of Our Services.
  • You will never share your Account login information with anyone, including any other user of Truco Patrão or any representative of Arya. You specifically understand and agree that We will not incur any liability for information provided by You to anyone which may result in your Account being exposed or misused by any other person;
  • You acknowledge that You have all legal rights or applicable licenses regarding the use of any content and materials that You may transmit, upload, or otherwise make available on the Platform, and that You do not your violate any intellectual property rights of a third party;
  • You shall use your Wallet solely for the purpose of playing the Games offered through Our Services, and not to launder funds or commit any other unlawful or prohibited activity;
  • You will be responsible for complying with all applicable laws and regulations related to playing the Cash Games;
  • You comply with the requisite skills and age required to play Games on the Platform, and that You are not aware of or suffering with any physical or mental condition that would impair your capability to fully participate in such activity;
  • You are aware that playing Cash Games may result in financial loss. With full knowledge of the facts and circumstances surrounding this activity, by using the Platform, You are voluntarily choosing to play Games and accordingly assume all responsibility for and risk resulting from your participation in any Cash Game or other activity on the Platform, including any financial loss. You understand that Arya shall not be liable for any financial loss that You may sustain because of your use of the Platform. You agree to indemnify and hold Arya, its employees, directors, officers, and agents harmless with respect to any and all claims and costs associated with your use of the Platform;
  • You understand and accept that your participation in a Game does not create any obligation on Us to give You a prize. your winning a prize is entirely dependent on the outcome of the Game, and your skill as a player vis-à-vis other players in the Game, and is further subject to the Platform Policies;
  • Arya is not responsible for your inability to access or play any Game or event in which You may be eligible to participate, irrespective of the cause of such event. This includes situations where You are unable to log into your Account or the same may be pending validation or You may be in suspected or established violation of any of the Platform Policies.
  • You understand that any Fair Play Violation by You or non-adherence to these Terms shall be deemed to be a breach of contract by You;
  • You are strictly prohibited from using the Service to facilitate any type of illegal money transfer system. You will not use the Service for any unlawful or fraudulent activity or prohibited transaction (including money laundering) under the laws of the jurisdiction that applies to you. If we have a suspicion that you may be engaged in or have engaged in fraudulent, unlawful or improper activity, including (but not limited to) money laundering activities or conduct that violates this Term, your access to the Service will be terminated immediately and/or your Account will be blocked. If your Account is terminated or blocked in such circumstances, we will only refund to You any funds that may be in credit of your Account at that time, in accordance with and to the extent permitted by applicable anti-money laundering laws, regulations, guidelines and implementing procedures, to the extent applicable to the suspected wrongdoing. Furthermore, we have the right to inform competent authorities, other online service providers and banks of your identity and of any suspected illegal, fraudulent or improper activity and you will fully cooperate with us to investigate such activities.

12. User Information Collection, Use And Protection

12.1. You agree and authorize Arya to collect your user information for the purposes of providing You the Services and access to the Platform, including your real-name registration information, game data of your Game account and other information You have provided during the use of the Service and the information collected by the Platform for the sake of information security and user experience optimization, and so forth.

12.2. The information collected would be stored in cloud server for such period as may be permitted under applicable laws and regulations, and the scope of use and purpose are as follows:

  1. Personal information that you share with us. And you hereby consent to provide the following specific information for the purpose.
  2. your age or birthday;
  3. your first and last names;
  4. your email address;
  5. game username(s);
  6. details about the games you play;
  7. your game history;
  8. your login data;
  9. other information that helps us make sure it’s You accessing your account, information necessary for us to provide the support You request, or information you provide to help us improve our Service (such as answers to an online survey or a feedback form).

12.3. When you use our Service, you can choose to create a player profile that other User’s can see. In your profile, you can include information like:

  1. choose a predefined avatar;
  2. game username(s);
  3. your gender;
  4. your age or age range;
  5. approximate location information;
  6. links to your profiles on various social networks;
  7. details about the games you play.

12.4. Personal information that we get from others and You hereby consent to provide the following specific information for the purpose: We may obtain information about You from other sources, such as third-party accounts like Facebook. We combine this information with the details you provide directly to us, and use it in various ways as outlined in this Privacy Notice. The type of information we receive depends on the third-party account, your privacy settings, and, where applicable, your friends’ privacy settings on that third-party platform.

12.5. You understand and agree that, if competent authorities require Arya to assist in investigating your Game account (including real-name identity information) and Game-related data (such as recharge, consumption and transaction data) in accordance with laws, We may provide the aforementioned relevant information to the competent authorities.

12.6. You shall fully respect the personal information of others, including but not limited to, the personal information of other users that You obtain, receive or have access to through the Game and related services. You should not collect, copy, store, propagate, or in any other way use other users’ personal information, otherwise You will be responsible for any consequences arising therefrom.

13. Content and Advertisements:

13.1. You are solely responsible for any content that You transmit, upload, or otherwise make available on Our Services and you acknowledge that We are not responsible or liable for any content that You may produce, post, store our upload in the Platform, or for any related losses or damages.

13.2. By publishing any content on Our Platform, You agree to grant Us a royalty-free, worldwide, non-exclusive, perpetual, and assignable right to use, copy, reproduce, modify, adapt, publish, edit, translate, create derivative works from, transmit, distribute, and publicly display your content (“User Content”), and to use such content in any related promotional or marketing materials produced by Us or Our affiliates. Such content may include, without limitation, your name, username, profile picture and other information provided on the Platform. You hereby agree and acknowledge that (i) any User Content is not confidential; (ii) You hold all applicable rights related to the User Content, including those necessary for posting them in the Platform; (iii) the User Content does not violate the applicable law, regulations and these Terms; (iv) the User Content does not have any illegal or unlawful content and does not harm any User.

13.3. By accessing, using or availing any part of Our Services, including the Communication Feature, You may be exposed to content posted by other users (“Third- Party Content). Arya does not have any property or control over the Third-Party Content. You acknowledge that We cannot be liable for any Third-Party Content, and that we have no responsibility for analysing such content.

13.4. We may place certain promoted or sponsored content on Our Platform (directly or via links to other sites or resources) in conjunction with third parties. We make no warranties with respect to such content and neither do we endorse any information contained therein. We shall not be liable to You for such promoted or sponsored content, and your interaction with such content or third-party resources shall be solely at your own risk.

13.5. We may use any content in relation to the Games played on the Platform, including recordings of the gameplay, for Our corporate and marketing purposes, and accordingly, You acknowledge, agree, and consent to our right in this regard.

14. Intellectual Property

14.1. Arya holds all intellectual property rights to the Platform and the Service provided therein. This includes copyrights, trademarks, patents, trade secrets, and other intellectual properties, as well as any other legitimate rights and interests of Truco Patrão. These rights encompass, but are not limited to, the entirety of the Game, including all artwork, music, text, and other game elements, components, and the dynamic visuals displayed during gameplay. Additionally, all information and content related to the Platform/Services—such as text, images, audio, video, graphics, interface designs, layout frameworks, data, or electronic documents—are protected by relevant local laws, regulations, and international treaties.

14.2. We retain ownership of these intellectual and legal rights, except those that may belong to third parties under applicable laws. We hereby grant You a limited, non-sublicensable, free license to access and use the Services for your personal purpose only. You are prohibited from using the Platform or its components (including art, music, text, and dynamic visuals) for any commercial purposes or other than the intended purpose. Also, You are prohibited from distributing its content through any information networks, modifying, or deriving use of the Services, whether in whole or in part. In the event of any breach of the provisions herein, We may revoke the license and adopt the necessary legal measures.

14.3. Nothing in this Terms shall be construed as conferring any express or implied license to any of Our intellectual property rights.

15. Disclaimer, Indemnity, and Limitation of Liability:

15.1. Arya is not liable for any claim, loss, injury, damages, expenses, or lost profits or winnings, incurred by You in connection with your use of the Services.

15.2. Arya disclaims any and all warranties, express or implied, related to the Service, which is provided to you “as is” and “as available”, and does not provide any warranty or representation regarding its operation, content, materials, quality, suitability for use, integrity, accuracy or any other service provided to You through the Platform. As provided by applicable law, We disclaim all implied warranties of merchantability and fitness for a particular purpose or use. No one is authorized to make any warranty on Our behalf, and Users may not rely on any other statement of warranty. However, where we receive adequate notice of an error in Our Services, We shall take prompt steps to rectify the same.

15.3. Notwithstanding anything to the contrary contained in these Terms, You agree that Our maximum aggregate liability for all your Claims against Us, in all circumstances, other than for a valid Withdrawal, is limited to the Platform Charge, paid to Us over the preceding three (3) months.

15.4. You are solely responsible for any consequence resulting from your use of the Platform, and You understand that We assume no liability or responsibility for any financial loss that You may sustain in this regard.

15.5. You agree to indemnify and hold harmless Arya against any claims, actions, suits, damages, penalties, or awards brought against Us by any entity or individual in connection with or in respect of your use of the Services.

15.6. Arya expressly disclaims all responsibility and liability for any harm, damages, or loss resulting from your participation in, or cancellation of, any Game, any activity or transactions with third parties whom You may have connected to through Our Services, and any user-generated content, including any violation of intellectual property rights with respect to such user-generated content.

15.7. A failure by Us, to insist upon strict performance of any of the provisions herein or to exercise any option, right or remedy contained herein, shall not be construed as waiver or relinquishment of such provisions, option, right or remedy. No waiver of any provision hereof shall be deemed to have been made unless expressed in writing and signed.

15.8. Arya reserves the right to suspend, discontinue, modify, remove or add something to the Service, at its sole discretion, with immediate effect and without any obligation to notify you in advance, where we consider it necessary to do so, including (for example) if we receive information that you have entered into any self-exclusion agreement with any game provider or where we consider it necessary for the administration, maintenance or updating of the software, without having any type of responsibility for any loss suffered as a result of any decision taken by Arya in this regard.

15.9. The latest versions of the Platform Policies, as published on the Platform, contain the entire agreement between You and Us regarding the access to and use of Our Services and supersedes all prior agreements, including prior versions of the Platform Policies.

16. Complaints and Disputes:

16.1. If You have any complaint or grievance relating to any aspect of the Services, You may approach Our customer care and grievance redressal team for the resolution of such issues by writing to support@TrucoPatrao.com.

16.2. You agree that all complaints and disputes at Truco Patrão are to be kept confidential. We will endeavour to resolve all grievances within a reasonable period, as mandated under applicable law. Any decision taken by Us relating to any complaint will be binding on the user.

17. Governing Law, Dispute Resolution, and Jurisdiction

17.1. The Platform Policies are governed by and shall be interpreted in accordance with the laws of Brazil.

17.2. Any dispute, controversy, or claim against Us or arising out of these Platform Policies shall be subject to the exclusive jurisdiction of Brazil. Nothing in this Clause shall limit Our right to take proceedings against You in any other court of competent jurisdiction, nor to take proceedings in any one or more jurisdictions, whether concurrently or not, to the extent permitted by the law of such other jurisdiction.

18. Miscellaneous:

18.1. If any provision of this Terms is or becomes illegal, invalid or unenforceable in any jurisdiction, this shall not affect the validity or enforceability in that jurisdiction of the remaining provisions hereof, nor the validity and enforceability in other jurisdictions of that or any other provision hereof.

18.2. We reserve the right to assign the rights arising from these Terms, in whole or in part, at any time and without notice. The User may not assign any of his/her rights and obligations arising from these Terms.
